Use of Message Boards, Blogs, etc. (“Boards”) are at your own risk.  Boards are available to those who are at least 18 years old or minors 13 years old and above who have parental permission.  Please use common sense and caution when accessing such Boards.  Users acknowledge that any Material posted (“Content”) is the sole responsibility of the individual ("User") who posted it along with any linked Content on external sites transmitted or otherwise via the Boards. You acknowledge and agree that JAM and Jamusa.com are not responsible for, does not control, does not endorse and does not verify the Content posted to the Boards or available through the Boards, and it makes no guarantee regarding quality, reliability, legitimacy and/or accuracy of such Content. Under no circumstances will JAM and Jamusa.com be liable in any way to you for Content, including, but not limited to, any errors or omissions in any Content or any loss or damage of any kind incurred as a result of the use of Content posted or otherwise transmitted via the Boards. Users using Boards provided by JAM and Jamusa.com to create boards and/or blogs agree to monitor the Content on their board and/or blog and make as "best and reasonable" efforts as can be taken to ensure compliance with the whole of these Terms. JAM and Jamusa.com are able to permit to access or post on their boards whom ever they so wish.  The board owners are also afforded the capability to block access to Users access/posting privileges on their Boards and JAM and Jamusa.com have the right, but no obligation to remove a ban or force Boards to accept membership for Users. JAM and Jamusa.com cannot restore any lost and/or deleted Boards, Accounts and/or Content and for which there will be no compensation. Limitation of Liability. Unless otherwise expressly provided, JAM and Jamusa.com in no event will be liable to you for any claims arising from the use of the Materials. Indemnity. You agree to defend, indemnify, and hold harmless JAM, Jamusa.com, its officers, directors, employees, and agents, from and against any claims, actions, or demands, including without limitation reasonable legal and accounting fees, alleging or resulting from your use of the Material or your breach of the terms of this Agreement. Export Control. The United States controls the export of products and information. You agree to comply with such restrictions and not to export or re-export the Materials to countries or persons prohibited under the export control laws. User Information. JAM and Jamusa.com may use the information it obtains relating its users, including IP address, name, mailing address, email address, and use of the Web Site, for its internal business and marketing purposes and may disclose the information to third parties for such purposes on an aggregate basis. Users who receive the Jamusa.com newsletter (“Jam Mail”) or related promotional materials may “unsubscribe” from Jam Mail by sending an email to the appropriate list: jammail@jamusa.com (Chicago), jammail-mn@jamusa.com (Minneapolis/St. Paul) and/or jammail-central@jamusa.com (Central Illinois) with “unsubscribe” in the subject line. Users under the age of 13 should not provide any personally identifiable information on Jamusa.com without the knowledge and consent of one’s parents or guardian. Any information that is found to be from a user under the age of 13 will not be maintained or used by Jamusa.com without verifiable consent from a parent or guardian, except as provided by law. As a result, some activities and/or sweepstakes may be restricted without verifiable consent. JAM and Jamusa.com reserve the right to cancel, delete, suspend and/or block any email(s) and/or correspondence including, but not limited to, those of an inappropriate, lewd, malicious, hateful nature as determined by JAM and Jamusa.com. JAM and Jamusa.com reserve the right to cancel, delete, suspend and/or block any email(s) suspected of being from individuals and/or organizations reselling tickets to JAM concerts and/or JAM live events, including but not limited to, ticket brokers, ticket scalpers, and/or ticket resellers. General. JAM Productions, Ltd. is based in Chicago, Illinois. Access to the Materials may not be legal by certain persons or in certain countries. If you access the Web Site from outside of the United States, you do so at your own risk and are responsible for compliance with the laws of your jurisdiction. This Agreement is governed by the internal substantive laws of the State of Illinois, without respect to its conflict of laws principles. If any provisions of this Agreement is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of this Agreement, which shall remain in full force and effect. No waiver of any term of this Agreement shall be deemed a further or continuing waiver of such term or any other term. This Agreement constitutes the entire Agreement between you and Jamusa.com with respect to the use of Jamusa.com.
